“Subscriber” means a user who has purchased or activated a paid subscription package on e-Tender SA.
Detailed Description of Goods and Services
e-Tender SA provides an electronic tender notification service to its users and subscribers, allowing them to receive tender notices, tender alerts, newsletters, platform notices, sponsored tender communications, and other related updates electronically.
Tender notifications and related communications may be delivered via email, website notifications, mobile application push notifications, SMS, phone calls, WhatsApp, or any other communication channel made available by e-Tender SA from time to time.
e-Tender SA may also distribute sponsored tender advertisements and sponsored business-related communications from third-party clients as part of its communication and advertising services.
Delivery Policy
Subject to availability, account status, subscription status, user preferences, and receipt of payment where applicable, users and subscribers may be notified of tenders electronically through email alerts, newsletters, website notices, mobile application push notifications, WhatsApp messages, SMS, phone calls, and other approved communication channels.
e-Tender SA will make reasonable efforts to deliver tender alerts and related communications, but does not guarantee that every tender notification will be received by the user due to factors outside its control, including but not limited to email filtering, spam settings, network failure, incorrect contact details, mobile device settings, WhatsApp delivery restrictions, or third-party service provider issues.
Communications, Sponsored Advertising, WhatsApp Communication and Email Delivery
By creating an account, subscribing, using the platform, requesting support, or opting in to communications from e-Tender SA, users acknowledge and agree that e-Tender SA may communicate with them for service-related, account-related, promotional, follow-up, advertising, and support purposes.

e-Tender SA uses Postmark, a secure and reliable email delivery service provider, to send bulk tender notifications, newsletters, sponsored tender advertisements, platform notices, system communications, and other email-based communications.
Postmark is used strictly as an email infrastructure provider to assist with the delivery of email communications on behalf of e-Tender SA.
e-Tender SA may also use WhatsApp, WhatsApp Business tools, SMS providers, customer support tools, hosting providers, payment providers, and other approved technology service providers to operate the platform and deliver communications to users.
e-Tender SA does not sell users’ personal information to third parties.
Where necessary, e-Tender SA may share limited user information with trusted service providers strictly for the purpose of operating the platform, processing payments, delivering communications, providing support, improving the service, or complying with legal obligations. Such service providers are only permitted to process the information for the purpose for which it was provided.
By using this service, users acknowledge and agree that they may receive sponsored tender advertisements and other sponsored business-related communications. These sponsored communications may appear in the header, body, or footer of:

Users may opt out of marketing, promotional, sponsored, or follow-up communications at any time by using the unsubscribe option provided, replying “STOP” where applicable, or contacting e-Tender SA Support at info@etendersa.co.za.
If a user opts out of marketing or promotional communications, e-Tender SA may still send important service-related, account-related, billing-related, security-related, or legal notices where necessary for the operation of the user’s account or subscription.
Users are responsible for ensuring that their contact details, including email address and phone number, are accurate and up to date.
Use of the Site
e-Tender SA reserves the right to amend these Terms and Conditions of Use at any time.
Users are responsible for ensuring that they are aware of the amended terms. Continued use of the website, platform, applications, or services after any changes have been made constitutes the user’s acceptance of the amended terms.
The information contained on this website is provided solely for tender notification, tender information, business opportunity awareness, and related communication purposes.
The user accepts full responsibility for the use of any information obtained from e-Tender SA.
Subscription and Access
Subscription to e-Tender SA constitutes a single-user license, meaning that only one user may access tender details per subscription purchased, unless otherwise agreed in writing by e-Tender SA.
Access to tender details is provided by means of a username and password, which may not be shared with any other person or organisation.
Users may view, copy, and download information and documents from the website for their own personal or internal business use only.
All information supplied by e-Tender SA is subject to copyright and may not be reproduced, copied, disclosed, distributed, provided, republished, resold, or used to create a competing service in its original or modified form without prior written permission from e-Tender SA.
Subscription fees are non-refundable, except where otherwise agreed by e-Tender SA at its sole discretion.
e-Tender SA reserves the right to suspend or terminate a subscription without notice if payment is not received by the due date, if the user breaches these Terms and Conditions, or if the user misuses the service.
e-Tender SA reserves the right to withdraw, suspend, amend, or discontinue any part of the service at any time without notice.
Billing and Automatic Renewal
When users first sign up and purchase a subscription, they will be billed immediately for their initial subscription period.
Where automatic renewal is enabled, the user’s subscription may renew automatically at the end of the subscription period, unless cancelled before the renewal date.
e-Tender SA reserves the right to increase subscription fees annually with at least 30 days’ notice.
Declination of Payment
If a payment method is declined, users must provide a new valid payment method promptly, failing which their subscription may be suspended or cancelled.
If a new payment method is provided and successfully charged, the subscription period may remain based on the original enrolment or renewal date.
Payment Terms
Payment may be made via Visa, MasterCard, approved payment gateway, bank transfer, or any other payment method made available by e-Tender SA.
Card transactions will be acquired via an approved payment gateway using secure encryption methods.
The merchant outlet country is South Africa, and the transaction currency is South African Rand (ZAR).
Refund Policy
Subscription fees are non-refundable.
Users who are dissatisfied with the service may request a refund by submitting a written application outlining their grievance.
e-Tender SA, at its sole discretion, may deny the claim, offer a credit, extend the subscription, or issue a refund.
Refund requests will be reviewed and processed within 30 days.
Cancellation or refund requests must be emailed to info@etendersa.co.za.
Disclaimers
e-Tender SA makes reasonable efforts to ensure the accuracy, reliability, and timeliness of the information published on the website and sent through its communication channels.
However, tender information may be obtained from third-party sources, advertisers, public sources, government portals, private organisations, and other external sources.
Neither e-Tender SA nor its employees, directors, representatives, or service providers warrant the accuracy, completeness, reliability, availability, or timeliness of any information published or communicated through the platform.
All information is provided “as is”, and users accept full responsibility for verifying tender details, deadlines, eligibility requirements, compulsory briefing dates, submission requirements, and any other tender-related information directly with the relevant issuing authority before acting on it.
e-Tender SA shall not be liable for any direct, indirect, incidental, special, or consequential damages, losses, claims, missed opportunities, failed submissions, loss of profit, or other damages resulting from the use of the service or reliance on any information provided.
e-Tender SA accepts advertising and tender notices from third-party clients and is not responsible for the content, accuracy, claims, offers, or representations submitted by advertisers.
e-Tender SA reserves the right to make improvements, correct errors, amend content, change services, or update these Terms and Conditions without prior notice.
Governing Law
This website and these Terms and Conditions are governed by the laws of South Africa.
